ABOUT THIS POLICY

This Privacy Policy explains how R.I.S.E Coaching Trinity (Pty) Ltd, trading as R.I.S.E. Coaching (“R.I.S.E.”, “we”, “us” or “our”), collects, uses, stores, shares and protects Personal Information.

It applies when you:

  • Visit risecoaching.co.za or another R.I.S.E. digital service;

  • Create an account;

  • Purchase a programme, subscription or assessment credits;

  • Use the R.I.S.E. Assessment Centre;

  • Complete a questionnaire or assessment;

  • Receive a personalised report;

  • Participate in a R.I.S.E. programme or online community;

  • Subscribe to email communications;

  • Submit information through a social-media lead form;

  • Contact us for support; or

  • Provide feedback, a review or testimonial.

“Personal Information” means information that identifies you or can reasonably be linked to you.

This Policy explains how R.I.S.E. processes your information. Platforms such as Shopify, PayFast, MailerLite, Skool and Google may also process information under their own privacy policies.

WHAT PERSONAL INFORMATION WE COLLECT

Depending on how you interact with R.I.S.E., we may collect:

Identity and contact information

  • First name and surname;

  • Email address;

  • Telephone number;

  • Country or general location;

  • Billing address;

  • Account username or profile information; and

  • Coach, practitioner or organisation details where relevant.

Purchase and payment information

  • Products or services purchased;

  • Shopify order number;

  • PayFast payment reference and payment status;

  • Subscription status and billing dates;

  • Assessment-credit purchases and usage;

  • Invoice and billing information; and

  • Refund, cancellation or payment-support information.

Payments are processed by PayFast and, where applicable, Shopify. R.I.S.E. does not intentionally store your complete payment-card number, CVV or online-banking credentials. We generally receive only the information needed to confirm and administer your payment, subscription or order.

Programme and community information

  • The programme you joined;

  • Access status and activation date;

  • Course progress or participation information made available through the relevant platform;

  • Community posts, comments or messages you choose to share;

  • Support requests; and

  • Records needed to activate or remove access manually.

Assessment Centre and questionnaire information

  • Assessment registration and account information;

  • Whether you are completing an assessment for yourself, through a practitioner, or through an organisation;

  • The practitioner, coach or organisation linked to an assessment;

  • Assessment or questionnaire answers;

  • Scores, profile results and result categories;

  • Completion status;

  • Personalised reports;

  • Credits assigned, used or restored;

  • Technical and audit records associated with an assessment; and

  • Information voluntarily entered into open-text fields.

Some assessments and questionnaires deal with personal subjects such as emotional wellbeing, stress, grief, relationships, childhood experiences, parent wounds, beliefs or other sensitive experiences. This information may constitute special Personal Information under the Protection of Personal Information Act 4 of 2013 (“POPIA”).

Please do not include identifiable information about another person in an open-text answer unless it is necessary and you are lawfully authorised to provide it.

Marketing and communication information

  • Newsletter registration details;

  • Marketing consent and unsubscribe status;

  • Resources, programmes or questionnaires you requested;

  • Email engagement information, such as delivery, opening or link activity;

  • Social-media lead-form information; and

  • Your communication preferences.

Website and device information

When you use our Site, Shopify and other authorised service providers may automatically collect:

  • IP address;

  • Browser and device type;

  • Operating system;

  • Time zone and approximate location;

  • Cookie or device identifiers;

  • Pages, programmes or products viewed;

  • Referring website or advertisement;

  • Search and navigation activity;

  • Cart and checkout activity; and

  • Dates and times of interactions.

Reviews, testimonials and user-provided content

If you provide a review or testimonial, we may collect the wording, your chosen display name, programme information and publication consent.

We will not publish identifiable feedback about sensitive personal experiences without appropriate permission.

WHERE WE OBTAIN PERSONAL INFORMATION

We may obtain Personal Information:

  • Directly from you;

  • From a practitioner, coach or organisation that lawfully assigns an assessment to you;

  • From Shopify, PayFast, Skool or another platform used to provide a service you requested;

  • From a questionnaire, newsletter or contact form;

  • From a Facebook, Instagram or other social-media lead form you choose to complete;

  • Automatically through cookies and similar technologies; or

  • From another lawful source where you have authorised the disclosure or where collection is otherwise permitted by law.

Where a practitioner or organisation provides your information to assign an assessment, that party must have lawful authority to do so and must inform you about the intended use of your information.

WHY WE PROCESS PERSONAL INFORMATION

We process Personal Information where it is necessary to:

  • Create and manage accounts;

  • Complete purchases and administer subscriptions;

  • Confirm payments and prevent fraud;

  • Activate, maintain or remove programme access;

  • Allocate and manage assessment credits;

  • Deliver questionnaires, assessments, results and reports;

  • Provide customer and technical support;

  • Communicate about orders, accounts, access or assessments;

  • Maintain accurate financial, tax, security and audit records;

  • Improve the security, performance and usability of our services;

  • Respond to lawful requests and comply with legal obligations;

  • Establish, exercise or defend legal rights;

  • Protect the legitimate interests of R.I.S.E., its customers or another person;

  • Send marketing where you have consented or where another lawful basis permits it; and

  • Carry out another purpose that was clearly explained when the information was collected.

Depending on the circumstances, processing may be based on your consent, the performance of a contract, a legal obligation, protection of a legitimate interest, or another justification permitted by POPIA.

REQUIRED AND OPTIONAL INFORMATION

Providing Personal Information is generally voluntary. However, certain fields are necessary to create an account, process a payment, allocate access, assign an assessment or produce a report.

If you do not provide information marked as required, we may be unable to provide the relevant product or service.

Marketing consent is optional. Refusing or withdrawing marketing consent will not prevent you from receiving a product, assessment or service you have already purchased. We may still send essential transactional, account, security or service messages.

SENSITIVE ASSESSMENT AND COACHING INFORMATION

R.I.S.E. will process sensitive assessment, questionnaire or coaching information only for the purpose communicated to you and where an appropriate lawful basis exists.

We take particular care to:

  • Collect only information reasonably required for the assessment or service;

  • Restrict access according to the user’s role;

  • Avoid using detailed answers or reports for unrelated marketing;

  • Avoid sharing results with unrelated third parties;

  • Use de-identified or aggregated information where individual identification is unnecessary; and

  • Obtain separate permission before using identifiable experiences as testimonials or case studies.

Detailed assessment answers and reports will not be sold, published or supplied to advertising platforms for targeted advertising.

If you separately consent to follow-up communication after requesting a questionnaire or resource, we may use your contact details and the general resource or area of interest you selected. We will not use your detailed answers or personalised report for marketing unless you have expressly agreed to that specific use.

ASSESSMENT RESULTS AND AUTOMATED PROCESSING

The Assessment Centre may use automated scoring or report-generation rules to convert answers into scores, profile categories and personalised reports.

These assessments are reflective, educational or developmental tools. They are not clinical diagnoses and are not intended to make decisions that produce legal consequences or affect you to a substantial degree without appropriate human involvement.

You may contact us if you believe a result is based on incorrect information or if you need an explanation of how your result was generated.

PRACTITIONER- AND ORGANISATION-ASSIGNED ASSESSMENTS

If you complete an assessment for yourself, your report is intended primarily for you.

If an assessment is assigned by a practitioner or coach, your identity, completion status, results or report may be made available to that assigned practitioner where this was disclosed as part of the assignment and is necessary to provide the requested service.

If an organisation pays for or facilitates an assessment, the information that the organisation will receive must be explained before you begin. An organisation will not automatically receive your detailed answers merely because it paid for an assessment.

R.I.S.E. may access assessment records where reasonably necessary to:

  • Provide technical or customer support;

  • Restore credits or correct system errors;

  • Generate or deliver a report;

  • Investigate suspected misuse;

  • Maintain security and audit records; or

  • Comply with legal obligations.

DIRECT MARKETING AND MAILERLITE

Where you subscribe, opt in through a lead form or otherwise lawfully agree to receive marketing, we may send information about R.I.S.E. programmes, assessments, resources, events and related services.

We currently use MailerLite to manage email subscribers, automated email sequences and unsubscribe preferences.

You may unsubscribe at any time by:

Unsubscribing from marketing does not stop essential communications about an existing purchase, subscription, account, assessment, report or support request.

We do not sell or rent our mailing list.

COOKIES AND SIMILAR TECHNOLOGIES

The Site may use cookies, pixels, tags and similar technologies for:

  • Essential storefront, account, security and checkout functions;

  • Remembering preferences;

  • Measuring Site traffic and performance;

  • Understanding how visitors use the Site;

  • Preventing fraud;

  • Measuring marketing campaigns; and

  • Delivering or measuring advertising where permitted.

Some cookies are necessary for the Site to function. Where optional analytics or advertising technologies are used, you may be offered choices through the Site’s cookie or privacy controls.

You can also block or delete cookies through your browser. Blocking essential cookies may prevent some Site, account or checkout functions from working correctly.

If you submit information directly through Facebook, Instagram or another platform, that platform will also process information under its own privacy policy.

HOW WE SHARE PERSONAL INFORMATION

We may share Personal Information only where reasonably necessary with:

Shopify powers our online store, checkout, customer accounts, order records and certain analytics.

Skool

Skool hosts certain R.I.S.E. programmes and online-community functions. Information required to create or manage access may be provided to Skool.

Google and Firebase services

Google or Firebase services may be used to host, secure and operate parts of the R.I.S.E. Assessment Centre, including authentication, data storage and application functionality.

Practitioners and organisations

Assessment information may be shared with an assigned practitioner, coach or organisation only as explained in this Policy and in the assessment-assignment process.

Review platforms

If you voluntarily submit a review through a review service such as Judge.me, the review platform will process the information you provide under its own privacy terms.

Professional and legal recipients

Information may be shared with accountants, legal advisers, IT or security specialists, insurers or other professional advisers where reasonably necessary and subject to appropriate confidentiality obligations.

Legal and safety disclosures

We may disclose information where required by law, a court order or a lawful request from a regulator or public authority, or where reasonably necessary to protect rights, safety, security or prevent fraud.

Business changes

If R.I.S.E. undergoes a lawful sale, merger, restructuring or transfer of business assets, Personal Information may form part of that transaction, subject to applicable legal safeguards.

We require service providers that process information on our behalf to use it only for authorised purposes and to apply appropriate security and confidentiality measures.

INTERNATIONAL TRANSFERS

Some service providers, including Shopify, MailerLite, Skool and Google, may store or process Personal Information outside South Africa.

Where Personal Information is transferred outside South Africa, R.I.S.E. will take reasonable steps to ensure that the transfer complies with section 72 of POPIA. This may include relying on adequate privacy laws, binding agreements, contractual safeguards, consent, contractual necessity or another basis permitted by law.

The privacy and data-protection standards in another country may differ from those in South Africa.

HOW LONG WE KEEP PERSONAL INFORMATION

We retain Personal Information only for as long as reasonably necessary for the purpose for which it was collected, including to:

  • Provide programme or lifetime access;

  • Maintain an active account or subscription;

  • Make assessment reports available;

  • Provide support;

  • Keep required financial, tax and transaction records;

  • Resolve disputes;

  • Prevent fraud;

  • Maintain security and audit records; and

  • Comply with legal obligations.

Detailed assessment information will be retained only while it remains necessary to provide the assessment service, report access, support or another lawful purpose. When it is no longer required, it will be securely deleted, destroyed, restricted or de-identified, subject to legal and technical requirements.

Marketing information is retained until you unsubscribe, withdraw consent or it is no longer needed. We may retain a minimal suppression record so that we can honour an unsubscribe request.

Backups may retain information temporarily until they are securely overwritten according to the relevant service provider’s backup cycle.

Fully de-identified or aggregated information that cannot reasonably be linked back to you may be retained for statistical, research, service-improvement or reporting purposes.

HOW WE PROTECT PERSONAL INFORMATION

We use reasonable technical and organisational safeguards appropriate to the nature and sensitivity of the information we process.

These safeguards may include:

  • Secure connections;

  • Authentication and access controls;

  • Role-based access to assessment information;

  • Restricted administrative access;

  • System logging and monitoring;

  • Backup and recovery measures;

  • Service-provider security requirements; and

  • Procedures for responding to suspected security incidents.

No online system can be guaranteed to be completely secure. You are responsible for protecting your passwords and notifying us promptly if you believe your account has been accessed without permission.

If we have reasonable grounds to believe that Personal Information has been accessed or acquired by an unauthorised person, we will investigate and notify the Information Regulator and affected data subjects where required by POPIA.

CHILDREN’S PERSONAL INFORMATION

The general Site and direct-purchase services are intended for adults.

R.I.S.E. will not knowingly process a child’s Personal Information unless the processing is lawfully authorised, including through the prior consent of a competent person where required, or another basis permitted under POPIA.

Where a practitioner or organisation intends to assign an assessment to a person under 18, this must be arranged through the appropriate authorised process. The practitioner or organisation must not submit a child’s information unless the necessary authority and consent have been obtained.

Please contact us if you believe a child’s information has been provided without proper authority.

YOUR PRIVACY RIGHTS

Subject to POPIA and other applicable law, you may have the right to:

  • Ask whether we hold Personal Information about you;

  • Request access to that information;

  • Ask us to correct or update inaccurate or incomplete information;

  • Request deletion or destruction where we are not legally entitled or required to retain it;

  • Object to certain processing;

  • Withdraw consent where processing is based on consent;

  • Object to direct marketing at any time;

  • Ask about the source of information not collected directly from you;

  • Ask which recipients or categories of recipients received your information;

  • Raise a concern about automated processing; and

  • Lodge a complaint with the Information Regulator.

Withdrawing consent does not affect processing that occurred lawfully before withdrawal, or processing that is justified on another lawful basis.

  • Your full name;

  • The email address linked to your account or purchase;

  • A description of your request; and

  • Any information reasonably needed to locate the relevant records.

We may need to verify your identity before releasing, changing or deleting information. Certain requests may be limited where retention or processing is required by law, necessary to protect another person’s rights, or otherwise permitted under POPIA.

We may update this Privacy Policy when our services, technology, service providers or legal obligations change.

The updated version will be published on the Site with a revised “Last updated” date. Where a change materially affects how we use sensitive information, we will provide additional notice or obtain consent where required.
