ABOUT THESE TERMS

These Terms of Service govern your use of the R.I.S.E. Coaching website, digital programmes, subscriptions, online communities, questionnaires, assessments, reports, coaching-related services and other digital products or services supplied by:

In these Terms, “R.I.S.E.”, “we”, “us” and “our” refer to RISE COACHING TRINITY (PTY) LTD. “You” and “your” refer to the person or organisation using or purchasing our products or services.

Our online store is hosted by Shopify. Some services are delivered through other platforms, including PayFast, Skool and the R.I.S.E. Assessment Centre.

ACCEPTANCE OF THESE TERMS

By visiting our website, creating an account, placing an order, purchasing a product or service, joining a programme or community, or using the Assessment Centre, you agree to these Terms.

Before completing a purchase, you must review the product description, price, payment arrangement and any product-specific conditions displayed at checkout.

If you do not agree to these Terms, you must not purchase or use the relevant product or service.

These Terms must be read together with our:

  • Privacy Policy;

  • Return and Refund Policy;

  • Product or service descriptions;

  • Assessment notices and consent statements; and

  • Any specific written agreement supplied before a coaching, training or practitioner service begins.

If product-specific terms were clearly displayed before purchase, those terms form part of your agreement with R.I.S.E.

Nothing in these Terms excludes or limits a consumer right that cannot lawfully be excluded.

ELIGIBILITY AND CHILDREN

Our general website, direct-purchase products and customer accounts are intended for people aged 18 or older.

If you are under 18, you may use a R.I.S.E. service only through an appropriately authorised process and with the consent of a parent, legal guardian or other competent person where required by law.

A practitioner, coach or organisation assigning an assessment to a person under 18 is responsible for ensuring that the necessary authority and consent have been obtained before submitting the person’s information.

ABOUT OUR PRODUCTS AND SERVICES

R.I.S.E. provides personal-development, educational, reflective and coaching-related products and services. These may include:

  • Digital programmes such as Moederwond;

  • Monthly or lifetime-access options;

  • Online learning and community access;

  • Questionnaires and reflective assessments;

  • Assessment credits;

  • Personalised assessment reports;

  • Coaching, facilitation, workshops or training; and

  • Free resources and discovery tools.

The exact content, duration, language, access arrangement and features included in a purchase will be described on the relevant product page or before checkout.

We aim to describe our products and services accurately. Images, examples, report previews and testimonials are illustrative and do not guarantee that every person will have the same experience or outcome.

Separate written terms may apply to private coaching, workshops, accredited training, practitioner services or organisational work. Where those specific terms conflict with these general Terms, the specific terms will apply to that service.

ACCOUNT REGISTRATION AND SECURITY

You must provide accurate, complete and current information when creating an account, purchasing a product, registering for a programme or using the Assessment Centre.

You are responsible for:

  • Protecting your password and secure access links;

  • Using an email address you can access;

  • Keeping your account information current;

  • Not sharing your login details with another person; and

  • Notifying us promptly if you believe your account has been accessed without permission.

An account, programme invitation or assessment link is intended for the person to whom it was issued. You may not allow another person to complete an assessment or access paid content under your identity.

We may ask you to verify your identity before changing account details, releasing a report, restoring access or responding to a privacy or refund request.

ORDERS, PRICES AND PAYMENTS

Prices are displayed in South African rand unless stated otherwise.

The price, payment type and products or services included in an order will be shown before payment. You are responsible for reviewing these details before completing your purchase.

Payments are processed through PayFast, Shopify or another payment method clearly identified at checkout. R.I.S.E. does not intentionally store your complete payment-card number, CVV or online-banking credentials.

An order is accepted once:

  • The payment has been successfully confirmed;

  • The order has not been identified as fraudulent or unauthorised; and

  • R.I.S.E. has not notified you of an obvious pricing or product error.

If payment was received for an order that we cannot fulfil, we will contact you and provide an appropriate refund or alternative agreed with you.

We may correct an obvious pricing, description or system error. We will not require you to accept a materially different product or an increased price after purchase without your agreement.

Future price changes will apply only prospectively. Where the price of an automatically renewing subscription changes, reasonable advance notice will be provided so that you can cancel before the new price takes effect.

DIGITAL ACCESS AND ACTIVATION

Access to programmes hosted on Skool or another external platform may be activated manually after payment has been confirmed.

Access will normally be provided within one business day unless a different timeframe was clearly stated before purchase.

You are responsible for:

  • Supplying the correct email address;

  • Accepting any access invitation sent to you;

  • Maintaining a compatible device and internet connection; and

  • Complying with the reasonable rules of the delivery platform.

If you have not received access within the stated period, contact irene@risecoaching.co.za.

R150 MONTHLY OPTION

Where the R150 monthly option is presented at checkout as an automatically renewing subscription, you authorise PayFast to charge R150 on the agreed monthly billing date until the subscription is cancelled.

If the checkout describes the R150 option as a once-off payment for one month’s access, it will not renew automatically and a new payment will be required to continue access.

The payment arrangement and PayFast authorisation shown before payment determine whether your purchase is recurring or once-off.

For an automatically renewing subscription:

  • Access is activated manually after the first successful payment;

  • You may cancel through PayFast, where available, or by emailing irene@risecoaching.co.za;

  • An emailed cancellation request should be submitted at least two business days before the next billing date to allow it to be processed;

  • Cancellation prevents future payments;

  • Access will normally continue until the end of the period already paid for; and

  • Access may be suspended or removed if a scheduled payment fails or the subscription ends.

Cancellation does not normally result in a partial refund for a month that has already begun, subject to the Return and Refund Policy and applicable consumer law.

R1,500 LIFETIME-ACCESS OPTION

The R1,500 lifetime-access option is a once-off payment and does not renew automatically.

“Lifetime access” means continued access to the named programme without further subscription fees for as long as R.I.S.E. continues to make that programme available.

Lifetime access:

  • Applies only to the programme and content identified at the time of purchase;

  • Does not automatically include future programmes, assessments, coaching sessions, workshops or unrelated products;

  • Does not guarantee that the programme will always remain on the same technology platform; and

  • Remains subject to these Terms, including the restrictions on sharing, copying and unlawful use.

If the programme moves from Skool to another platform, R.I.S.E. will take reasonable steps to provide equivalent access on the replacement platform.

If the programme must be permanently discontinued, R.I.S.E. will, where reasonably possible, provide appropriate notice and an equivalent access arrangement or another remedy required by law.

ASSESSMENT CREDITS

The R.I.S.E. Assessment Centre uses credits for certain paid assessments.

Unless a different promotional or packaged price is clearly displayed, one assessment credit costs R20.

The number of credits required for an assessment will be displayed before the assessment is assigned or started. Different assessments may require different numbers of credits.

Assessment credits:

  • May be purchased by an individual, practitioner or organisation;

  • May be assigned to a client through the authorised practitioner workflow;

  • Have no independent cash value outside the Assessment Centre;

  • May not be resold or transferred outside an authorised R.I.S.E. workflow;

  • Cannot be duplicated, manipulated or obtained through unauthorised means; and

  • Are subject to the Return and Refund Policy.

Credits will be deducted according to the on-screen assessment workflow.

If a technical fault for which R.I.S.E. is responsible prevents the assessment or report from being supplied, we will first attempt to correct the fault or restore the affected credit. If this cannot reasonably be done, an appropriate refund or alternative remedy will be provided.

You should download and retain any report you wish to keep. The availability and retention of reports are also governed by our Privacy Policy.

ASSESSMENTS, RESULTS AND REPORTS

R.I.S.E. assessments, questionnaires, scores and reports are designed for reflection, education, coaching and personal development.

They are not:

  • Clinical or psychological diagnoses;

  • Medical treatment or healthcare advice;

  • Psychotherapy;

  • Emergency or crisis support;

  • Legal, financial or employment advice; or

  • A substitute for assessment or treatment by an appropriately qualified professional.

Results are generated from the answers provided and the scoring or report-generation rules associated with the assessment. The usefulness of a result depends partly on the accuracy, completeness and honesty of the answers.

R.I.S.E. does not guarantee that:

  • A result will describe every aspect of a person’s experience;

  • Different assessments will produce identical conclusions;

  • A particular personal, relationship or career outcome will occur; or

  • Participation will remove the need for professional support.

Some programme or assessment content may address emotionally sensitive subjects. You may pause and seek appropriate support if the content becomes distressing.

R.I.S.E. is not an emergency service. A person who may be in immediate danger or experiencing a mental-health emergency should contact an appropriate emergency service, crisis service or qualified healthcare professional.

Assessment results should not be used as the sole basis for medical, legal, employment, disciplinary, insurance or other high-impact decisions.

PRACTITIONER- AND ORGANISATION-ASSIGNED ASSESSMENTS

A practitioner, coach or organisation assigning an assessment must:

  • Have lawful authority to provide the client’s information;

  • Use accurate client information;

  • Explain why the assessment is being assigned;

  • Explain who will receive the results or report;

  • Obtain any consent required by law;

  • Protect client reports and secure links; and

  • Use the assessment only within the practitioner’s competence and agreed service.

If an assessment is assigned by a practitioner or coach, the client’s completion status, results or report may be made available to that assigned practitioner where this was disclosed before completion.

An organisation does not automatically receive a participant’s detailed answers merely because it paid for an assessment. The information the organisation will receive must be explained before the participant begins.

Practitioners remain responsible for their own professional advice, interpretation, conduct and services. R.I.S.E. is not responsible for an independent practitioner’s promises, advice or use of an assessment outside the authorised workflow.

COMMUNITY PARTICIPATION AND CONDUCT

A R.I.S.E. programme or community may allow members to post messages, comments, questions or other content.

You agree to communicate respectfully and not to:

  • Harass, threaten, bully or discriminate against another person;

  • Publish unlawful, defamatory, abusive or obscene content;

  • Share another member’s personal story, post or identifying information outside the community without permission;

  • Impersonate another person;

  • Advertise, solicit or spam members without authorisation;

  • Upload malicious code or unsafe links; or

  • Use the community to provide services that you are not lawfully or professionally qualified to provide.

IMPORTANT COMMUNITY PRIVACY NOTICE

R.I.S.E. expects members to respect one another’s privacy, but we cannot guarantee that another member will keep information confidential or will not copy, screenshot or repeat something that was shared.

Do not post information that you do not want other community members to see. Private assessment answers and reports should not be posted publicly in a community area.

We may moderate or remove content and may restrict community access where reasonably necessary to protect members, enforce these Terms or comply with the law.

INTELLECTUAL PROPERTY AND PERMITTED USE

The website and R.I.S.E. materials are owned by or licensed to R.I.S.E. and are protected by applicable intellectual-property laws.

Protected materials may include:

  • The R.I.S.E. name, branding and logos;

  • Programme videos, audio, text and exercises;

  • Course structures and workbooks;

  • Assessment questions and scoring logic;

  • Report templates, graphics and explanations;

  • Downloads, presentations and training materials; and

  • Website design, photographs and written content.

A purchase gives you a limited, personal, non-exclusive and non-transferable right to access and use the purchased material for its intended purpose. Ownership of the material is not transferred to you.

Unless R.I.S.E. gives written permission, you may not:

  • Share, sell, sublicense or distribute paid access;

  • Copy or reproduce substantial parts of a programme;

  • Record or redistribute programme videos or live sessions;

  • Publish assessment questions or scoring rules;

  • Reverse engineer or attempt to recreate an assessment;

  • Remove copyright or ownership notices;

  • Use R.I.S.E. content to create a competing product; or

  • Use the branding in a way that suggests an unauthorised partnership or endorsement.

A practitioner may use a legitimately generated report when providing the agreed service to the assigned client. This does not permit the practitioner to copy, modify, resell or independently reproduce the assessment system or report template.

USER-PROVIDED CONTENT, REVIEWS AND TESTIMONIALS

You retain ownership of original content you submit.

When you post content in a R.I.S.E. community or submit information needed to provide a service, you give R.I.S.E. limited permission to store, display, process and transmit that content only as reasonably necessary to operate the service, provide support, moderate the community or comply with the law.

You must not submit content that:

  • Belongs to another person without permission;

  • Violates another person’s privacy or intellectual-property rights;

  • Is knowingly false or misleading;

  • Contains unlawful or harmful material; or

  • Contains identifiable information about another person that you are not authorised to provide.

Submitting private feedback does not automatically give R.I.S.E. permission to publish it as an identifiable testimonial or case study. Appropriate permission will be obtained before identifiable personal experiences are used publicly.

THIRD-PARTY PLATFORMS AND LINKS

R.I.S.E. uses third-party services to operate parts of its business. These may include Shopify, PayFast, Skool, MailerLite, Google and Firebase.

Your use of a third-party platform may also be subject to that platform’s own terms and privacy policy.

R.I.S.E. is not responsible for unrelated products, content or services supplied independently by a third party merely because our website contains a link to that party.

This clause does not remove any responsibility R.I.S.E. has for selecting and using service providers reasonably or for fulfilling its obligations to you under applicable law.

SERVICE AVAILABILITY AND CHANGES

We aim to keep our website and digital services available and secure. However, temporary interruptions may occur because of maintenance, updates, internet failures, security incidents or problems affecting an external platform.

Where reasonably possible, we will attempt to restore access and communicate material interruptions.

We may improve, update or replace programme features, platform arrangements or assessment functionality. Changes will not intentionally remove the essential benefit of an existing paid purchase without an appropriate alternative or remedy.

We may discontinue a product or stop accepting new purchases. Discontinuing future sales does not automatically remove rights already acquired by existing customers.

CANCELLATIONS, REFUNDS AND CONSUMER RIGHTS

Cancellations, subscription cancellations, cooling-off rights and refund requests are governed by our Return and Refund Policy and applicable South African law.

Nothing in these Terms:

  • Removes a cooling-off right that applies by law;

  • Excludes the right to receive services of the quality required by law;

  • Excludes a remedy for a service that was not supplied as agreed;

  • Excludes liability for gross negligence or intentional misconduct; or

  • Requires a consumer to waive a right that cannot lawfully be waived.

PROHIBITED USE

You may not use the website, programmes, communities, Assessment Centre or other services:

  • For an unlawful or fraudulent purpose;

  • To violate another person’s rights;

  • To obtain unauthorised access to an account, report or system;

  • To scrape, copy or harvest data or assessment content;

  • To interfere with security or access controls;

  • To introduce viruses, malware or destructive code;

  • To manipulate credits, scores, payments or reports;

  • To misrepresent your identity, qualifications or authority;

  • To complete an assessment in another person’s name;

  • To exploit or target vulnerable community members;

  • To send spam or unauthorised marketing; or

  • In a manner that could reasonably harm R.I.S.E., its users or its service providers.

SUSPENSION AND TERMINATION

You may stop using our services at any time. Subscription cancellation and refunds remain subject to the applicable payment and refund terms.

We may restrict, suspend or terminate access where reasonably necessary because:

  • You materially breach these Terms;

  • Payment is reversed, fraudulent or overdue;

  • An account poses a security risk;

  • You misuse programme or assessment content;

  • You threaten or seriously harm another user;

  • Continued access would be unlawful; or

  • An external platform requires the action for a valid reason.

Where appropriate, we will give notice and a reasonable opportunity to correct the problem. Immediate action may be taken where necessary to protect people, information, intellectual property or system security.

Termination does not remove rights or payment obligations that arose before termination. It also does not require us to delete records that must be retained by law or under our Privacy Policy.

IMPORTANT SERVICE AND LIABILITY TERMS

R.I.S.E. will provide its services with the quality, care and timeliness reasonably required by applicable law.

Personal-development, coaching and assessment services depend on individual participation and circumstances. We do not promise a specific emotional, relationship, financial, career or other personal outcome.

To the extent permitted by law, R.I.S.E. is not responsible for loss caused solely by:

  • Incorrect information supplied by you;

  • Your failure to protect login details or secure links;

  • Unauthorised use contrary to these Terms;

  • An independent practitioner’s conduct or advice;

  • A third-party service that R.I.S.E. could not reasonably control; or

  • An event outside our reasonable control.

Where R.I.S.E. breaches an obligation, responsibility will be determined under the agreement and applicable South African law, taking into account whether the loss was reasonably foreseeable and directly connected to the breach.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from gross negligence, intentional misconduct or a non-waivable consumer right.

Additional consent or privacy notices may be displayed before a sensitive questionnaire, assessment or practitioner-assigned service begins.

GENERAL LEGAL TERMS

These Terms, the incorporated policies, the relevant product description and any applicable service-specific agreement form the agreement between you and R.I.S.E. for the relevant product or service.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be limited or removed only to the extent necessary.

A failure or delay by either party to enforce a right does not automatically waive that right.

You may not transfer your account, subscription, lifetime access or rights under these Terms to another person without written permission, except through an authorised practitioner-client workflow.

GOVERNING LAW AND DISPUTES

These Terms and your relationship with R.I.S.E. are governed by the laws of the Republic of South Africa.

Please contact us first if you have a complaint so that we can attempt to resolve it fairly.

Nothing in these Terms prevents a consumer from approaching the National Consumer Commission, a consumer court, an ombud with jurisdiction, the Information Regulator or another competent court or regulatory body.

CHANGES TO THESE TERMS

We may update these Terms when our services, technology, pricing structures or legal obligations change.

The revised version will be published with a new “Last updated” date.

A change will not retrospectively remove a right already acquired through a completed purchase unless the change is required by law or is accepted by you.

Where a material change affects an active paid subscription or service, we will provide additional notice where reasonably required.
